Resumen
Resumen: Cuando está en peligro la vida de una persona adulta que profesa la religión de Testigos de Jehová y debe realizarse una transfusión sanguínea, existe una tensión entre dos derechos fundamentales protegidos constitucionalmente: el derecho a la vida y el derecho a profesar libremente un culto. Pero cuando se trata de un menor de edad y sus padres se niegan a que sea transfundido, poniendo en riesgo la vida del menor, entran además en conflicto los derechos del niño, niña o adolescente y la responsabilidad del personal médico que debe atender a ese menor para salvarle la vida. En este trabajo se describen diversas aristas jurídicas de estos casos complejos con la finalidad de analizar el conflicto de derechos existentes, a los fines poder determinar qué derecho debe prevalecer. Para ello fue necesario indagar las normas constitucionales en conflicto, la normativa relacionada y/o aplicada; y la jurisprudencia. Esta investigación tuvo como fin arribar a la conclusión de que hay supuestos en los que no está justificado el respeto a las decisiones de los pacientes Testigos de Jehová, y en donde debe prevalecer el derecho a la vida sobre cualquier otro derecho involucrado.
Abstract: When the life of an adult who professes the religion of Jehovah's Witnesses is in danger and must undergo a blood transfusion, there is a tension between two constitutionally protected fundamental rights: the right to life and the right to freely profess a religion. But when it is a minor and theirparents refuse to allow them to be transfused, putting the minor's life at risk, the rights of the child or adolescent and the responsibility of the medical personnel who must care for that child in order tosave their life come also into conflict. In this work, various legal aspects of these complex cases are described in order to analyze the struggle of existing rights; in order to determine which right should prevail. For this it was necessary to investigate the constitutional norms in conflict, the related and/or applied regulations; and the jurisprudence. ?e purpose of this research was to arrive at the conclusion that there are cases in which respect for the decisions of Jehovah's Witness patients is not justified, and where the right to life must prevail over any other right involved.
