Resumen
Resumen: El presente trabajo tiene como objetivo el análisis del derecho alimentario como derecho humano fundamental.
En tal sentido, abordaremos su análisis desde una perspectiva de derecho humano, tal como lo prevén los diferentes instrumentos internacionales que se refieren al derecho alimentario de niñas, niños y adolescentes, personas adultas mayores, personas con discapacidad y aquellas personas que por alguna situación en particular se encuentren en estado de vulnerabilidad social o económica y no puedan procurarse el sustento por sí mismas.
Bajo esa línea observaremos las dificultades que propone la efectivización y garantía de este derecho humano fundamental y los desafíos que implica. En este orden de ideas desarrollaremos la temática de la responsabilidad internacional del Estado en la materia de conformidad con los mencionados instrumentos internacionales.
Por último, nos referiremos al conjunto de medidas posibles tanto en el plano internacional como en el plano interno para asegurar el cumplimiento de la obligación.
Analizar el derecho alimentario desde esta perspectiva nos abre un abanico de posibilidades y requiere respuestas acordes con la complejidad que esta cuestión plantea.
Abstract: The objective of this work is to analyze the right to food as a fundamental human right. In this sense, we will approach its analysis from a human rights perspective, as provided for in the different international instruments that refer to the right to food of children and adolescents, the elderly people with disabilities and those people who, due to a particular situation, are in a state of social or economic vulnerability and cannot provide for their own sustenance. Under this line we will observe the difficulties that the implementation and guarantee of this fundamental human right proposes and the challenges it implies. In this order of ideas, we will develop the topic of the international responsibility of the State in the matter in accordance with the afore-mentioned international instruments. Finally, we will refer to the set of possible measures at the international and domestic levels to ensure compliance with the obligation. Analyzing the right to food from this perspective opens up a range of possibilities and requires answers in accordance with the complexity of the issue.
