Resumen
El presente trabajo busca dar respuesta al siguiente interrogante: ¿qué responsabilidad le cabe a los proveedores e intermediarios en los entornos digitales? En nuestro país no contamos con normativa específica sobre responsabilidad de los intermediarios, lo cual representa un problema para la Justicia. Nuestro Código Civil y Comercial establece dos regímenes de responsabilidad civil: subjetiva y objetiva a la hora de resolver los conflictos que llegan a los estrados judiciales. Como no hay un régimen legal específico para aplicar en casos sobre responsabilidad de intermediarios, el Poder Judicial recurre a estos principios generales de la responsabilidad civil a la hora de pronunciarse, lo cual genera diversas posturas y fallos en las distintas instancias, contrarios unos de otros.
En ese marco, se propone un abordaje desde la mirada y el trabajo que lleva adelante la Autoridad de Aplicación Administrativa, con apoyo del presente artículo en sanciones de carácter administrativo.
This paper seeks to answer the following question: what responsibility do providers and intermediaries have in digital environments? In our country we do not have specific regulations on the responsibility of intermediaries, which represents a problem for Justice. Our Civil and Commercial Code establishes two civil liability regimes: subjective and strict when resolving conflicts that reach the courts. Since there is no specific legal regime to apply in cases of intermediary liability, the Judiciary resorts to these general principles of civil liability when it comes to pronouncing, generating different positions and rulings in different instances contrary to each other.Within this framework, an approach is proposed from the point of view and the work carried out by the Administrative Enforcement Authority, supporting this article on sanctions of an administrative nature.
