Resumen
Resumen: El criterio del magistrado más que un límite del derecho disciplinario de los jueces constituye el centro del núcleo de su fundamento axiológico que se articula en la independencia e imparcialidad concebida como deber del magistrado. El criterio del juez se construye dentro del debido proceso como diferente al mero arbitrio, estructurándose como parte de un edificio conceptual filosófico-político de una estimativa de la dignidad humana que retoma la consciencia de Auschwitz y la crítica al Estado Legislativo, de ética burocrática. A partir de la independencia e imparcialidad, se conciben como valores adyacentes necesarios para su realización en medio de la específica circunstancia (coordenada espacio temporal) los otros valores como la integridad, corrección, equidad, competencia y diligencia, lo que lleva a una mejor comprensión del derecho disciplinario.
Abstract: The judge's legal conception, rather than a limit on the disciplinary law of judges, constitutes the core of its axiological foundation, which is articulated in the independence and impartiality conceived as the judge's duty. the judge's legal conception is constructed within due process as distinct from mere arbitrariness, structured as part of a philosophical-political conceptual edifice of an estimation of human dignity that revisits the Auschwitz consciousness and the critique of the legislative state, of bureaucratic ethics. Based on independence and impartiality, other values such as integrity, correctness, equity, competence, and diligence are conceived as adjacent values necessary for their realization within the specific circumstance (space-time coordinate), which leads to a better understanding of disciplinary law.
