Resumen
La asimetría en las relaciones de consumo produce, entre otras consecuencias, la exposición de los consumidores a múltiples y continuas situaciones de «pequeños maltratos», que implican disgustos y pérdida de tiempo. Ello disminuye su calidad de vida, entendida como una reducción de probabilidades vitales que, a los fines de su cuantificación, puede describirse como una «pérdida de chance de disfrute».
Si bien el daño moral colectivo no está expresamente regulado, existen antecedentes jurisprudenciales; y el juego de los arts. 1737, in fine, 1738, 240 y 1741, in fine, del CCC brinda pautas para su determinación y cuantificación. El deber de seguridad del art. 5 de la Ley de Defensa del Consumidor, complementado por los arts. 1757 y 1758 del CCC, incluye la prevención y el resarcimiento de daños originados en externalidades negativas, causados por proveedores a consumidores potenciales e indeterminados.
