Resumen
El presente trabajo tiene por objeto analizar el concepto de laicidad positiva en dos recientes fallos de la Corte Suprema de Justicia.
Observaremos el análisis que hace el máximo tribunal en cuanto al alcance y medida de los derechos de libertad de culto, intimidad, no discriminación y algunos principios, como el de neutralidad religiosa. Nuestro ordenamiento jurídico sostiene la libertad de cultos. Es importante destacar que el Estado no tiene un trato igualitario con las distintas iglesias y credos. Igualdad significa tener un trato distinto a quienes están en distintas situaciones. El Estado, basado en razones de índole sociológica al momento de sancionarse la Constitución Nacional, tiene un trato preferente con la Iglesia católica. Si bien la situación fáctica de ambos casos es totalmente distinta, en ellos se ilustra el sostenimiento de la laicidad positiva.

The purpose of this paper is to analyse the concept of positive secularism in two recent rulings from the Supreme Court of Justice.
We will observe the analysis made by the Supreme Court regarding the extent of the rights as freedom of worship, privacy, non-discrimination, and some principles such as religious neutrality.Our legal system supports the freedom of religion. We will observe that the State has a significant dissimilar treatment with the churches. Equality means having different treatment for those who are in different situations. Based on history and a sociological impact, the State has a preferential treat-ment with the Catholic Church. The facts are different. However, in both of them, we will observe the support for positive secularism.
