| dc.description.abstract | Las reflexiones de estas líneas, tienen su punto neurálgico en el fortalecimiento de la constitucionalización de los derechos privados, en especial sobre el colectivo de los consumidores, en punto tal que el propio Código Civil y Comercial vigente protege como derecho humano la vulnerabilidad social de aquel colectivo, que se revela en la patente desigualdad que existe entre los contratantes. Entiendo que hoy la desigualdad patente es el conflicto que debemos resolver todos los operadores judiciales, a través de la justicia restaurativa como política judicial de igualdad real. | |
| dc.description.abstract | The reflections in these lines center on strengthening the constitutionalization of private rights, especially those of consumers, to the point that the current Civil and Commercial Code itself protects, as a human right, the social vulnerability of this group, which is revealed in the blatant inequality that exists between contracting parties. I understand that today, this blatant inequality is the conflict that all judicial operators must resolve through restorative justice as a judicial policy of true equality. | |
