| dc.description.abstract | El presente artículo busca reflexionar respecto de los contratos a partir de una de sus derivaciones inmediatas: el cumplimiento de las obligaciones que el este conlleva, entendiendo que depende, esencialmente, de la supervivencia de la «causa fin», en virtud del carácter necesario que reviste este elemento de los contratos (arts. 281 y 1013, CCCN). De ahí que, si se produce la frustración de la causa fin, el contrato puede llegar a extinguirse (art. 1090, CCCN). Se propone un recorrido por la importancia del tema, su régimen legal, el ámbito de aplicación, sus efectos y la jurisprudencia sobre la cuestión. Hence, if the frustration of the final cause occurs, the contract may become extinct (art. 1090, CCCN). We propose a tour of the importance of the subject, its legal regime, the scope, its effects and the jurisprudence on the issue. | |
