dc.description.abstractEl avance de las nuevas tecnologías está modificando dramáticamente la dinámica de nuestras sociedades. El derecho, como ciencia social, no puede permanecer indiferente frente a este fenómeno. Han surgido novedosas amenazas para los bienes jurídicos que demandan la intervención penal a través de la tipificación de nuevos comportamientos delictivos y también nuevas formas para cometer, a través de medios digitales, infracciones que ya se encuentran tipificadas. Y es aquí donde surge un nuevo tipo de afectación de bienes jurídicos, y que, cuando tengan como víctima a las mujeres, denominaremos: violencia de género digital.La presente comunicación propone indagar respecto de este nuevo fenómeno, así como también analizar su tratamiento en el Sistema Penal Argentino y su impacto ante la pandemia de COVID-19. As a result the Law cannot remain indifferent to this phenomenon.New threats have emerged for legal rights that demand criminal intervention through the classification of new criminal behaviors and also new ways to commit offenses by using digital means that have been already classified. This is the point where a new type of legal rights violation arises. As a matter of fact, when they have women involved as victims we will classify them as digital gender violence.This article proposes to inquire into this new phenomenon, as well as to analyze its treatment in the Argentine Criminal System, and its impact during the COVID-19 pandemic.
