Resumen
El Estado nacional, a través de la Resolución 236/21, reconoce la participación de los niños, niñas y adolescentes en los procesos administrativos, especialmente en aquellos relacionados con las relaciones de consumo en las que se les considera sujetos protagónicos. Esta resolución está en línea con la Observación General 16 del Comité de los Derechos del Niño de la ONU, que establece que los niños tienen derecho a ser escuchados en los procedimientos judiciales y administrativos que involucren a empresas. La Resolución 236/21 establece herramientas para que los derechos y garantías reconocidos puedan ejercerse efectivamente en las relaciones de consumo y reconoce a los niños como sujetos especialísimos de derecho. La participación de los padres y representantes legales es fundamental para facilitar el ejercicio de los derechos de los niños, niñas y adolescentes, pero la resolución busca incluir a todas las partes involucradas para enriquecer las relaciones sociales.
The National Government, through Resolution 236/21, recognizes the participation of children and adolescents in administrative processes, especially those related to consumer relations in which they are considered leading subjects. This resolution is in line with the UN Committee on the Rights of the Child’s General Comment 16, which establishes that children have the right to be heard in judi-cial and administrative proceedings involving businesses. Resolution 236/21 establishes tools so that recognized rights and guarantees can be effectively exercised in consumer relations and recognizes children as special subjects of law. The participation of parents and legal representatives is essential to facilitate the exercise of the rights of children and adolescents, but the resolution seeks to include all parties involved to enrich social relations.
