| dc.description.abstract | Este trabajo reflexiona sobre la enumeración legal que incorpora, en el Código Civil y Comercial de la Nación, como derechos reales “la propiedad indígena”, los “conjuntos inmobiliarios”, los “tiempos compartidos”, los “cementerios privados”, “la superficie”. Es fácil advertir que todos ellos existían o estaban presentes en nuestra realidad negocial, pero su falta de regulación generaba interpretaciones y fallos judiciales contradictorios, con lo cual su establecimiento legal busca establecer un marco de referencia para analizar las cuestiones jurídicas que se plantean a su respecto, lo que permite dar cobertura a la transformación social y económica que exige creatividad, formación jurídica y sensibilidad social. | |
| dc.description.abstract | This work reflects on the legal enumeration incorporated into the Argentine Civil and Commercial Code as real property rights, including “indigenous property,” “real estate developments,” “timeshares,” “private cemeteries,” and “surface rights.” It is readily apparent that all of these existed or were present in our business practices, but their lack of regulation led to contradictory interpretations and judicial rulings. Therefore, their legal establishment seeks to create a framework for analyzing the legal issues that arise concerning them, thus providing a framework for the social and economic transformation that demands creativity, legal training, and social awareness. | |
