dc.description.abstractEl ensayo reflexiona sobre el décimo aniversario del Código Civil y Comercial de Argentina (CCCN), enfatizando el papel central de la persona humana como núcleo y medida del derecho civil. Con base en el artículo 51 del CCCN, el texto destaca que la persona humana es sujeto de derechos desde la concepción hasta la muerte, afirmando la dignidad como un valor intrínseco e inviolable, y no como una creación del derecho. Este enfoque antropocéntrico redefine la interpretación de todas las instituciones civiles —contratos, familia, herencias y responsabilidad civil—, garantizando que el derecho esté al servicio del bienestar humano y no de la eficiencia económica.
dc.description.abstractThe essay reflects on the tenth anniversary of Argentina's Civil and Commercial Code (CCCN), emphasizing the central role of the human person as the core and measure of civil law. Rooted in Article 51 of the CCCN, the text highlights that the human person is a subject of rights from conception to death, affirming dignity as an intrinsic and inviolable value rather than a creation of law. This anthropocentric approach reshapes the interpretation of all civil institutions—contracts, family, inheritance, and torts—ensuring that the law serves human welfare rather than economic efficiency.
