dc.description.abstractEl presente artículo aborda la importancia del dictamen previo emitido por los servicios jurídicos permanentes como requisito esencial al dictado del acto administrativo. A partir de un fallo de la Corte Suprema de Justicia de la Nación, se procura analizar el alcance jurídico y práctico de este requisito y primordialmente su función como garantía del administrado de que el obrar por parte de la autoridad estatal se circunscribió al bloque de juridicidad. Asimismo, se examina la evolución normativa del requisito a la luz de la reforma introducida por la Ley de Bases y Puntos de Partida para la Libertad de los Argentinos N.° 27.742.
dc.description.abstractThis article addresses the importance of the prior opinion issued by permanent legal services as an essential requirement for the issuance of administrative acts. Based on a ruling by the Supreme Court of Justice of the Nation, it seeks to analyze the legal and practical scope of this requirement and, primarily, its function as a guarantee for the administered party that the actions of the State authority were limited to the scope of legality. It also examines the regulatory evolution of the requirement in light of the reform introduced by Law No. 27,742 on the Foundations and Starting Points for the Freedom of Argentines.
