Resumen
A diez años de la sanción del Código Civil y Comercial de la Nación, se advierte un fenómeno singular: la incorporación de normas procesales dentro de un cuerpo normativo tradicionalmente de derecho privado. Este híbrido plantea desafíos interpretativos y prácticos, ya que intersecta con principios constitucionales y con el derecho a la tutela judicial efectiva, reconocido por la Constitución Nacional y por la Corte Interamericana de Derechos Humanos. El artículo pretende ejemplificar algunas de las disposiciones del CCCN en materia procesal, como la prueba, la competencia y las sucesiones, entre otras, examinando la tendencia hacia la oralidad, con un perfil del juez humanista, dado el contacto directo de jueces y partes, y una justicia temprana. Asimismo, se reflexiona sobre el rol de los jueces en garantizar una justicia eficiente y accesible, y se evalúa el impacto de estas normas en la construcción de un derecho privado constitucionalizado y más cercano a la ciudadanía. Se concluye que, pese a los avances, persisten desafíos de coherencia normativa y de armonización con los códigos procesales, invitando a un diálogo continuo entre normas de fondo y procedimientos.
Ten years after the enactment of the Argentine Civil and Commercial Code, a singular phenomenon emerges: the incorporation of procedural rules within a traditionally private law framework. This hybrid raises interpretative and practical challenges, intersecting with constitutional principles and the right to effective judicial protection, as recognized by the National Constitution and the Inter-American Court of Human Rights. The article analyzes the most relevant CCCN provisions regarding procedural matters, including evidence, jurisdiction, and succession, highlighting trends toward oral proceedings and early justice. It also reflects on the role of judges in ensuring efficient and accessible justice and evaluates the impact of these rules on the construction of a constitutionalized private law closer to citizens. Despite progress, challenges in normative coherence and harmonization with procedural codes remain, inviting continuous dialogue between substantive and procedural norms
